Welcome to BFF Here! The terms “we”, “us” and “our” refer to BFF Here. BFF Here operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). BFF Here is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products and services to you.

FRAUD PREVENTION & CHARGEBACK POLICY

All orders are subject to fraud verification and review. We reserve the right to cancel any order suspected of fraudulent activity. Orders with mismatched billing and shipping information or flagged as high-risk may be delayed, canceled, or refunded at our discretion. Any order automatically flagged by our system will be canceled with no notice.

By placing an order, you agree that:

The transaction is authorized by the cardholder.
The billing information provided matches the payment method used.
You will not initiate a chargeback for orders that have been processed and shipped in accordance with our policies, including our Pre-Order Terms below.
Any attempt to initiate a fraudulent or unjustified chargeback may be considered a violation of this agreement.
BFF Here reserves the right to dispute all chargebacks and provide supporting documentation, including order records and these Terms, to financial institutions.
We cooperate with payment processors and law enforcement regarding fraudulent activity.

If you have any issue with your order, please contact us at hello@bffhere.com so we can resolve it directly. Failure to contact us prior to initiating a chargeback may result in delayed resolution or restriction of future purchases.

SHIPPING — STANDARD ORDERS

$6.99 flat rate ground shipping, and free ground shipping on orders over $75.00, applies to orders placed and shipped within the United States only.

BFF Here utilizes multiple warehouses. As a result:

Items within a single order may ship separately and arrive at different times, each with its own tracking number.
By placing an order, you acknowledge and agree to receive partial shipments.
Available items ship as they become available; remaining items ship upon fulfillment.
Multiple orders shipping to the same address may be consolidated and shipped together.

Orders begin processing immediately and cannot be canceled or changed once placed. Standard U.S. orders ship within 7-10 business days of purchase (occasionally up to 14 business days). Business days are Monday-Friday and exclude weekends and holidays. Processing times are estimates, not guaranteed delivery dates.

International orders ship via DHL or USPS, are not eligible for flat rate or free shipping, and may take up to 60 days to arrive due to shipping and customs processing, which varies by country. Import duties, if any, are the customer’s responsibility.

We are not liable for shipping delays caused by carriers, customs, or other events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you. BFF Here is not responsible for lost, stolen, or damaged packages; please contact USPS or UPS directly with your tracking number. If your package shows as delivered by the carrier, you will need to contact your local Post Office or UPS branch for further information. If there is a problem with your tracking number or delivery, please contact the courier directly before contacting us.

PRE-ORDER TERMS & CONDITIONS

Certain items on our site are offered for pre-order due to limited availability or manufacturer production and shipping timelines. By placing a pre-order, you acknowledge and agree to the following:

Estimated delivery for pre-order items is approximately 1-4 months from the date of order. This timeframe depends on our manufacturer’s production and shipping schedule and is an estimate, not a guaranteed date.
Payment is collected in full at the time the pre-order is placed. Your order is confirmed and guaranteed upon receipt of payment.
We will provide periodic status updates by email, including order confirmation, production updates, and shipping notification once your item ships.
If a delay extends meaningfully beyond the stated 3-4 month window, we will notify you and you may choose to continue waiting or request a full refund.
Pre-order items ship as soon as they arrive at our facility; tracking information is provided at that time, not before.
Because this extended timeline is disclosed and agreed to at checkout, we ask that you contact us at hello@bffhere.com with any questions or concerns before initiating a chargeback or dispute, so we can resolve the issue directly.

RETURNS & EXCHANGES

To start a return or exchange, please click here.

We will only ship to the address submitted at checkout — please ensure it is accurate. Items returned to us due to an insufficient or incorrect address will incur a re-ship fee.

Refund eligibility: Returns received within 7 days of delivery are eligible for a refund. Returns received between 8-14 days are eligible for store credit only. No returns are accepted after 14 days.

Damaged or incorrect items: Contact us within 3 business days of receiving a damaged, incorrect, or wrong-size item, preferably with photos, at hello@bffhere.com. After 3 business days, we are unable to replace or refund damaged items.

Return authorization: You must contact us before sending anything back to obtain a return authorization number and return address. Returns sent without authorization will not be processed and we are not liable for them. All returns must be sent via USPS only — do not use UPS.

Return deadlines: Returns must be mailed and postmarked within 7 days of the date your return authorization was issued. Returns postmarked 8+ days after authorization incur a 20% restocking fee, deducted from your refund. Returns not received within 30 days of authorization will not be accepted and will be returned to the customer at their expense. Refunds are not processed until the item is received; if an authorized return is never received, we will assume the customer chose to keep the item and no refund will be issued.

Condition: Returned items must arrive in the same condition as shipped. Items that are broken, damaged, or appear worn will not be credited, and the customer will be responsible for return shipping costs. Color and pattern variation due to photography, lighting, or screen display does not qualify as a defect. Clothing, jewelry, and shoes may not be exchanged or returned after wear. Items marked “final sale” are not returnable. All swimwear is final sale.

Return shipping: Customers are responsible for all return shipping costs, which are non-refundable. We recommend tracking and insuring your return; we are not responsible for items lost or damaged in transit to us — claims for that must be filed with the shipping carrier. Refunds are processed within 14 days of receiving the returned merchandise.

Exchanges: Follow the return process above to exchange an item for a different size of the same item. The exchange is processed once we receive the original item back.

We are unable to hold items for a pending return.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and that you have given consent for any minor dependents to use the Services on devices you own or manage.

To use the Services, you may be asked to provide information such as your email, billing, payment, and shipping details. You represent that all information you provide is correct, current, and complete, and that you have the right to provide it.

You are solely responsible for the security of your account credentials and all account activity. You may not transfer, sell, assign, or license your account to anyone else.

SECTION 2 - OUR PRODUCTS

We make every effort to accurately represent our products. Colors or appearance may vary based on your device and screen settings; we do not warrant that products will appear identical to how they’re depicted online. Product descriptions are subject to change at any time. We reserve the right to discontinue any product or limit quantities offered to any person, region, or jurisdiction.

SECTION 3 - ORDERS

Placing an order is an offer to purchase; it is not accepted until we confirm it. We must receive and process payment before an order is accepted. Orders generally cannot be canceled or changed once accepted — please review your order carefully before submitting. If we decline, modify, or cancel an order, we will attempt to notify you using the contact information provided at checkout.

Purchases are subject to return or exchange solely per the Returns & Exchanges section above. You represent that your purchases are for personal or household use, not for commercial resale or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. You will be charged the price in effect at the time your order is placed, as confirmed in your order confirmation email. Posted prices exclude taxes, shipping, handling, customs, and import charges unless stated otherwise.

You agree to provide current, complete, and accurate billing and account information, and to promptly update it as needed. You represent that: the payment information you provide is true and complete; you are authorized to use the payment method provided; charges will be honored by your card issuer; and you will pay all charges incurred, including shipping, handling, and applicable taxes.

SECTION 5 - SHIPPING AND DELIVERY

We are not liable for shipping or delivery delays. All delivery times, including pre-order estimates, are estimates only and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. Risk of loss and title pass to you once products are transferred to the carrier.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including all trademarks, text, displays, images, graphics, product reviews, video, and audio, and their design, selection, and arrangement, are owned by BFF Here, its affiliates, or licensors, and are protected by U.S. and foreign intellectual property law.

These Terms permit personal, non-commercial use of the Services only. You may not reproduce, distribute, modify, create derivative works from, publicly display or perform, republish, download, store, or transmit any material from the Services without our prior written consent. Nothing in these Terms grants any license or right under our (or Shopify’s, or any third party’s) patents, trademarks, or copyrights except as expressly stated. BFF Here’s names, logos, and slogans are our trademarks or those of our affiliates/licensors; Shopify’s name and logo are trademarks of Shopify. All rights not expressly granted are reserved.

SECTION 7 - OPTIONAL TOOLS

We may give you access to third-party tools that we do not monitor or control. These tools are provided “as is” and “as available,” without warranty or endorsement, and any use of them is at your own risk. We have no liability arising from your use of third-party tools and recommend reviewing the relevant third party’s own terms before using them. Any new features or tools we add in the future are also subject to these Terms.

SECTION 8 - THIRD-PARTY LINKS

The Services may link to third-party websites or content we do not control. We are not responsible for evaluating their accuracy or content, and accessing them is at your own risk. We are not liable for any harm related to your use of third-party sites, products, or services — direct any related complaints to the third party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

BFF Here is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with BFF Here. Shopify is not responsible for any aspect of sales between you and BFF Here, including any injury, damage, or loss resulting from purchased products. You release Shopify and its affiliates from all claims, damages, and liabilities arising from your purchases and transactions with BFF Here.

SECTION 10 - PRIVACY POLICY

Personal information we collect is governed by our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes information about your use of the Services to help provide and improve them, and may share it with third parties as needed to provide services to you, including in other countries. Review our Privacy Policy and Shopify’s Privacy Policy for details.

SECTION 11 - FEEDBACK

If you submit ideas, suggestions, reviews, or other feedback (“Feedback”), you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and distribute it for any purpose, including commercial use. We have no obligation to keep Feedback confidential, compensate you for it, or respond to it. We may, but are not obligated to, monitor, edit, or remove Feedback we deem unlawful or objectionable. You represent that your Feedback won’t violate any third party’s rights and won’t contain unlawful, abusive, or malicious content, and that you won’t misrepresent your identity in submitting it. You are solely responsible for your Feedback.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Information on our site, including product descriptions, pricing, promotions, shipping charges, and availability, may occasionally contain errors. We reserve the right to correct errors and to change, update, or cancel orders affected by inaccurate information at any time, including after an order is submitted.

SECTION 13 - PROHIBITED USES

You may use the Services only for lawful purposes. You may not use the Services to: violate any law or regulation; infringe our or others’ intellectual property rights; harass, abuse, or harm any person; transmit false or misleading information; send spam, chain letters, or unauthorized advertising; impersonate any person or entity; or engage in conduct that restricts others’ use of the Services or exposes us or others to liability. You also agree not to: upload viruses or malicious code; reproduce, duplicate, or resell any part of the Services; collect or track others’ personal information; phish, pharm, pretext, spider, crawl, or scrape; or interfere with the security features of the Services. We may suspend, disable, or terminate your account at any time, without notice, for violating these Terms.

SECTION 14 - TERMINATION

We may terminate this agreement or your access to the Services, in our sole discretion, at any time without notice, and you remain liable for all amounts due as of the termination date. Provisions that by their nature should survive termination — including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, and Governing Law — will continue to apply.

SECTION 15 - DISCLAIMER OF WARRANTIES

Information on the Services is provided for general informational purposes only; we do not warrant its accuracy, completeness, or usefulness, and any reliance on it is at your own risk.

EXCEPT AS EXPRESSLY STATED, THE SERVICES AND ALL PRODUCTS OFFERED ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT FULLY APPLY TO YOU.

SECTION 16 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, BFF HERE, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS — AND THOSE OF SHOPIFY — WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOST DATA, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SECTION 17 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless BFF Here, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, and service providers from any claims, damages, liabilities, or costs (including reasonable attorneys’ fees) arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Services. We will notify you of any indemnifiable claim and may control its defense and settlement at your expense, though we won’t settle in a way that imposes non-monetary obligations on you without your consent.

SECTION 18 - SEVERABILITY

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remainder of these Terms will remain in full effect.

SECTION 19 - WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. These Terms, together with any referenced policies, constitute the entire agreement between you and us regarding the Services, superseding any prior agreements or communications. Ambiguities in these Terms will not be construed against the drafting party.

SECTION 20 - ASSIGNMENT

You may not assign or transfer this agreement or your rights under it without our written consent. We may assign or transfer these Terms without notice or consent.

SECTION 21 - GOVERNING LAW

These Terms are governed by the laws of the United States and the state in which BFF Here is headquartered. You consent to venue and personal jurisdiction in the courts of that jurisdiction.

SECTION 22 - HEADINGS

Headings in this agreement are for convenience only and do not affect the interpretation of these Terms.

SECTION 23 - CHANGES TO TERMS OF SERVICE

We may update these Terms at any time by posting changes to our website. It is your responsibility to review this page periodically. We will provide notice of material changes as required by law, and continued use of the Services after changes are posted constitutes acceptance of those changes.

SECTION 25 - SMS/MMS MOBILE MESSAGE MARKETING PROGRAM TERMS AND CONDITIONS

BFF Here (“We,” “Us,” “Our”) offers a mobile messaging program (the “Program”). By opting in to or participating in the Program, you agree to these terms, including resolution of disputes through binding, individual arbitration as described below.

Opt-In: By opting in (e.g., through an online or app-based enrollment form), you agree to receive autodialed or prerecorded marketing messages at the phone number you provide. Consent is not required to make a purchase from us. Message and data rates may apply.

Opt-Out: Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message to opt out. You may receive one additional confirmation message. These are the only recognized methods of opting out.

Duty to Notify: If you stop using or transfer the phone number associated with the Program, you agree to opt out first. If you fail to do so, you agree to be responsible for costs and liabilities we incur as a result of messages later sent to that number’s new owner, and you agree to indemnify us against related claims, including under the Telephone Consumer Protection Act.

Program Description: Messages may concern marketing and sales of digital and physical products, services, and events. Message frequency varies based on your interaction with us.

Support: Text HELP to the number you received messages from, or email hello@bffhere.com (this email cannot be used to opt out — opt-outs must go through the STOP process above).

Disclaimer: The Program is offered “as is” and may not be available in all areas or work with all carriers. We are not liable for delayed or undelivered messages, which depend on your wireless carrier and are outside our control.

Eligibility: You must have a wireless device capable of two-way messaging and be a subscriber with text messaging service. You must be at least 13 years old; users between 13-18 must have parental or guardian permission.

Prohibited Content: You agree not to send fraudulent, threatening, harassing, obscene, or discriminatory content; malicious code; unlawful product or service promotions; protected health information; or any other content prohibited by applicable law.

Dispute Resolution: Any dispute between you and us, or between you and our messaging service provider, relating to this Program will be resolved by binding arbitration in Deerfield Beach, Florida, before a single arbitrator, under the Commercial Arbitration Rules of the American Arbitration Association (AAA), and governed by the Federal Arbitration Act. Arbitration will proceed on an individual basis only — class arbitration and representative claims are not permitted. The arbitrator may not award punitive damages, and each party waives any right to seek them. If a dispute proceeds in court rather than arbitration for any reason, both parties waive the right to a jury trial. This provision survives cancellation or termination of the Program.

Miscellaneous: You represent that you have the authority to agree to these terms. We may update this Agreement at any time and will communicate material changes to you; continued participation after changes constitutes acceptance.

I also removed the duplicated/contradictory second copy of the general terms that was stacked underneath the first, and dropped the “labels are preprinted” line and the bracketed [INSERT...] placeholders that were never filled in — you’ll want to add your actual business address, phone, and registration number back into Section 24 if you have them.
